GENERAL TERMS OF SERVICE

You must be at least the age of majority in your jurisdiction to use our services or access this site. You agree not to use our services for any illegal or unauthorized purpose or to violate any applicable laws.


TERMS SPECIFIC TO POINT OF SALE SERVICES

2.1 Software Licensing and Use

Any software provided by Star POS, including POS systems such as PAR Brink, PixelPoint, Stellar, Xenial, Genuis and others, is licensed, not sold. Use of such software is subject to the applicable end-user license agreements (EULAs) and vendor-specific terms. Unauthorized distribution, modification, or reverse engineering is strictly prohibited.

2.2 Hardware Warranties and Limitations

POS hardware sold or leased by Star POS is subject to the original equipment manufacturer's warranty. Star POS offers depot repair services as well as on-site technical support where applicable. Extended warranties or service plans may be offered for additional fees.

2.3 Installation and Configuration Services

Installation of hardware and software may be provided by Star POS or its authorized contractors. You agree to provide suitable access to your premises for installations and assume responsibility for ensuring adequate infrastructure (e.g., power, internet connectivity) is in place.

2.4 Remote Support and Help Desk

Star POS may provide remote technical support services for subscribed customers. Response times and support scope are governed by applicable Service Level Agreements (SLAs). You acknowledge that timely resolution may depend on third-party systems or services.

2.5 Internet and Data Security Disclaimer

While we take commercially reasonable steps to secure customer data, including encryption and firewalls, Star POS is not responsible for data loss, service interruption, or breach due to actions by third parties, including cloud hosts, payment gateways, or cyberattacks.


PAYMENT TERMS AND SERVICE FEES

All prices and fees are subject to change without notice. Invoices are due based on the payment terms stated therein. Late payments may incur service suspension or interest charges.

Service fees paid by credit card may be subject to a processing surcharge as disclosed at time of payment.


LIMITATION OF LIABILITY SPECIFIC TO POS SERVICES

In no event shall Star POS be liable for:

- Downtime, data loss, or revenue loss due to POS system failure or external software updates;

- Interruptions caused by internet outages or third-party vendor issues;

- Indirect damages arising from user errors, misuse, or delays in service installation;

- Loss or damage arising from the use of any software not provided or authorized by Star POS.

Our total liability shall not exceed the amount paid by you for the service in the six (6) months preceding the event giving rise to liability.


SERVICE MODIFICATIONS, UPGRADES, OR TERMINATION

Star POS reserves the right to update, suspend, or discontinue any service or platform feature at any time. Upgrades may require additional hardware or licensing fees.


RETURNS AND CANCELLATIONS

Returns are accepted on eligible products in accordance with our Return Policy. Custom installations, software licenses, and opened hardware may be non-refundable.

Termination of ongoing service contracts may be subject to early termination fees as outlined in specific agreements.


DATA INTEGRITY AND BACKUP

It is the customer’s responsibility to maintain regular backups of their data. Star POS may offer backup solutions, but these are not guaranteed unless covered under a specific contract.


CUSTOMER RESPONSIBILITIES

Customers are responsible for:

- Maintaining current and accurate contact, billing, and user information;

- Promptly reporting any suspected data breaches or system issues;

- Ensuring their employees follow best practices for security and system use.


GOVERNING LAW

These Terms shall be governed by the laws of the Province of Alberta, Canada, without regard to its conflict of law provisions.


AMENDMENTS

We may update these Terms of Service from time to time. Your continued use of the website and services constitutes acceptance of the revised terms.
